This Privacy Policy explains how we handle personal information you provide us on websites owned or controlled by Matt Scarpaci d/b/a DAMN SEXY ABS (“DSA”), including the websites of any subsidiaries and/or affiliates which link to this Privacy Policy (collectively referred herein to as “DSA Websites”). This Privacy Policy is not applicable to any personal information which may have been collected from you offline, or to any websites, whether they are owned or controlled by DSA or not, that do not link to this Privacy Policy, or to third-party websites to which the DSA Websites may link.
Your use of a DSA Website indicates your acceptance of and your agreement to comply with this Privacy Policy outlined below and to the Terms of Use.
How does this Privacy Policy define "personal information"? “Personal information” means information that identifies you or could reasonably be used to identify you and which is submitted to and/or collected by DSA Websites and which is maintained by DSA in an accessible form. Examples of personal information include your name, your address and your telephone number.
How does DSA collect information online? DSA collects information in two ways:
Personal Information You Submit: DSA collects personal information you enter into data fields on DSA Websites. For example, you may submit your name, address, email address, and/or other information in order to receive information about various subjects, register for programs, contact customer service, or respond to surveys. To protect your privacy, you should not provide any information not specifically requested.
Passive Collection of Unidentifiable Information: DSA Websites may also collect information about your traffic to and on DSA Websites without your active submission of information. Unidentifiable information may be collected using various technologies, such as cookies, Internet tags, and web beacons. Your Internet browser automatically transmits to DSA Websites some of this unidentifiable information, such as the URL of the website you just visited and the browser version your computer is operating. Does DSA consolidate personal information? DSA may consolidate personal information of customers who use DSA Websites. What choices do I have about how DSA collects and uses personal information about me? You may always limit the amount and type of personal information DSA receives about you by not entering personal information into forms or data fields on DSA Websites. However, some of our online services may only be available to you if you provide certain personal information. Who will have access to personal information about me? Personal information will only be accessible by a restricted number of DSA employees, certain companies with whom DSA may conduct joint programs, and/or by individuals and entities with whom DSA contracts to carry out certain business activities on DSA’s behalf. We train our employees about the importance of privacy and how to appropriately handle, manage and secure customer data. DSA requires contractors who may have access to your personal information to not only secure such information but also to use such information only in the performance of its services on DSA’s behalf. It is our intention to notify you when you register for any program conducted by DSA in conjunction with any another company that may require access to your personal information.
Does DSA share personal information with third parties? Unless it is necessary to provide access to your personal information in order to conduct a joint program or carry out a program or activity with a contractor, such as for credit card processing, DSA does not generally share your personal information with any third party and, whenever applicable, you will be provided with an opportunity to opt in or opt out of the program. In the event DSA sells one of its product lines or divisions, your personal information may be transferred to the buyer so that the buyer can continue to provide you with information and services. DSA requires contractors who may have access to your personal information to not only secure such information but also to use such information only in the performance of its services on DSA’s behalf.
Notwithstanding anything contained herein to the contrary, DSA reserves the right to disclose your personal information to respond to authorized information requests from government authorities, to address national security situations, or when otherwise required by law.
How does DSA secure personal information? It is DSA’s practice to secure each web page that collects personal information; however, the confidentiality of personal information transmitted over the Internet cannot be guaranteed. We urge you to exercise caution when transmitting any personal information over the Internet regardless the nature of the information. DSA cannot guarantee an unauthorized party will not gain access to your personal information; therefore, when submitting personal information to DSA Websites, you must weigh both the benefits and the risks. In addition, DSA Websites covered by this Privacy Policy will display a warning whenever you link to a website not controlled by DSA or not subject to this Privacy Policy. We recommend that you review the privacy policies of any such third-party websites before submitting personal information.
DSA has policies, which provide for the proper use and protection of social security numbers which may be obtained in the course of doing business with DSA. DSA’s policy requires all social security numbers be appropriately secured to avoid loss, misuse or unauthorized access. Unlike this Privacy Policy, which applies only to online personal information, DSA’s policies governing social security numbers apply to both online and offline collection and use of social security numbers.
How does DSA protect the privacy of children? DSA does not knowingly collect or use any personal information from children (for purposes of this Privacy Policy, "children" are defined as minors younger than thirteen (13) years of age) on DSA Websites. We do not knowingly allow children to order any DSA products, communicate with us, or use any of our online services. If you are a parent and become aware that your child has provided us with information, please contact us using one of the methods specified below, and we will work with you to address this issue.
How may I correct personal information or delete it from current customer records? You may request to remove your personal information from our current customer records or to amend your personal information. Please notify us of your wishes by contacting us in one of the ways specified below. For our record keeping purposes, we will retain certain personal information you submit in conjunction with commercial transactions.

communications to DSA, please include the email address used for registration
(if applicable), the DSA Website URL or the specific DSA program to which you provided
personal information (e.g.
DSA.com, etc.), and a detailed explanation of your request. If you would like to delete or amend your
personal information and are contacting us by email, please put “Deletion
Request” or “Amendment Request”, as applicable, in the subject line of the
email. We will do our best to respond to all requests in a timely manner.
How will I know whether DSA has updated this policy? DSA reserves the right to amend this Privacy Policy without prior notice to reflect technological advancements, legal and regulatory changes and good business practices. If DSA changes its privacy practices, the revised Privacy Policy will posted and the effective date of the revised Privacy Policy will be set forth in this paragraph. This Privacy Policy was last updated on March 6, 2012 and is effective as of that date.
